Terms of Service

1. Agreement to these Terms

These Terms of Service ("Terms") govern your access to and use of CosmoCalls Services operated by Praxis Computing LLC dba CosmoCalls ("CosmoCalls", "Cosmo", "we", "us"). When you click to accept these Terms during signup, on a marketing form, or an in-product legal acceptance flow, you agree to be bound by them.

2. Eligibility and account responsibility

  • You must be legally able to enter into a binding contract in your jurisdiction.
  • You are responsible for maintaining the confidentiality of your credentials and all activity under your account.

3. Subscriptions and billing

Some features may require paid subscriptions. Fees, billing cycles, and usage limits will be displayed in the product or on our pricing pages. Taxes may apply.

4. Acceptable use

You agree not to:

  • Use the Services for unlawful, harmful, or deceptive purposes.
  • Violate any telephony, privacy, or marketing laws (e.g., consent requirements).
  • Attempt to interfere with the integrity or security of the Services.
  • Reverse engineer or misuse the Services except where permitted by law.

5. Customer data and integrations

You retain ownership of data you submit to the Services ("Customer Data"). You grant Cosmo a limited license to process Customer Data to provide and improve the Services. If you enable third-party integrations, those providers’ terms and policies apply.

6. Service availability and changes

We may update or modify the Services over time. We do not guarantee that the Services will be uninterrupted, error-free, or available at all times.

7. Intellectual property

Cosmo and its licensors retain all rights, title, and interest in the Services, including software, designs, and trademarks. These Terms do not grant you any rights to Cosmo’s trademarks or branding.

8. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, COSMO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COSMO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

10. Indemnification

You agree to indemnify and hold harmless Cosmo from and against claims arising from your use of the Services, your Customer Data, or your violation of these Terms.

11. Termination

You may stop using the Services at any time. We may suspend or terminate access if we reasonably believe you have violated these Terms or if necessary to protect the Services or other users.

12. CosmoCalls SMS program

The CosmoCalls SMS program sends marketing text messages from CosmoCalls about product updates, promotions, tips, and event invites to people who expressly opt in (for example, via the contact form at https://cosmocalls.com/contact).

  • Message and data rates may apply.
  • Message frequency varies.
  • Customer support: email support@cosmocalls.com or reply HELP to any CosmoCalls text.
  • To opt out, reply STOP. You will receive a confirmation and no further CosmoCalls marketing messages will be sent to that number unless you opt in again.
  • Our Privacy Policy is available at https://cosmocalls.com/privacy.
  • Carriers are not liable for delayed or undelivered messages.

Consent to receive marketing texts is not a condition of purchasing CosmoCalls products or services.

13. Changes to these Terms

We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify you (for example, via the product or email). When required, we may ask you to accept an updated version before continued use of the Services.
